englischUnder what conditions can judges in Germany use digital applications for decision-making? The thesis illustrates the limits and shows up a solution. In addition to legal-theoretical and computer-specific limits, the legal framework set by the German constitution and European law must be observed. The editor’s focus lies on the guarantee of judicial independence, which must not be questioned by the use of technology. A certification procedure for determined programs is proposed to resolve the emerging conflict. Finally, concrete examples of applications are highlighted.
