englischThe paper investigates the existence of the so-called principle of finality, as well as the principle of causality concerning German law of statutory health insurance, since the existence of the first one is often singled out. First, the conceptuality at the basis for the paper is developed. The main part then analyses the selected codes, which apply to the treatment in case of disease, to point out final and causal structures that can express the existence of the appropriate principle. Since final as well as causal structures are established, the existence of both principles is one of the results of the paper. Resulting from the domination of the final structures in the analysed codes, another result is the prevalence of the principle of finality.
Die Untersuchung ist der Existenz eines Finalitäts- bzw. Kausalitätsprinzips im Recht der Gesetzlichen Krankenversicherung gewidmet. Hintergrund ist, dass oftmals von der Existenz lediglich eines Finalitätsprinzips ausgegangen wird, eine Herleitung dessen aber bislang nicht erfolgt ist. Es wird zunächst die Begrifflichkeit des Prinzips erarbeitet, die der Untersuchung zugrunde gelegt wird. Den Hauptteil bildet eine detaillierte Untersuchung der Regelungen betreffend die Sachleistungen bei Krankheit als ausgewählte Regelungsmaterie des SGB V auf finale und kausale Elemente als Ausdruck entsprechender Prinzipien. Dabei werden sowohl finale als auch kausale Strukturmuster festgestellt, die wiederkehrend auftreten, wobei die finalen Elemente gegenüber den kausalen insgesamt in den Vordergrund treten. Somit gelangt die Untersuchung u.a. zu dem Ergebnis der Koexistenz eines Kausalprinzips sowie eines Finalprinzips als gegenüber ersterem dominanteren Prinzips.
