englischThe study examines the extent to which the ECJ's interpretative principles on the use of inside information have been implemented in the current market abuse regime (MAR and MAD II). The study focuses on the substantive and procedural effects of the so-called Spector rule. The author elaborates the dogmatic classification of this rule and examines its conformity with European law.
From a criminal law perspective, it is examined for its compatibility with constitutional law and fundamental principles of criminal procedure, as well as for its applicability in national criminal proceedings.
Die Arbeit untersucht, inwieweit die vom EuGH aufgestellten Auslegungsgrundsätze zum Merkmal der Nutzung von Insiderinformationen nunmehr im geltenden Marktmissbrauchsregime (MAR und MAD II) implementiert wurden. Gegenstand der Untersuchung ist die materiell-rechtliche und strafprozessuale Wirkung der sog. Spector-Regel. Die Verfasserin arbeitet die dogmatische Einordnung dieser Regel heraus und untersucht sie auf ihre Europarechtskonformität.
Ausgehend von einer strafrechtlichen Perspektive wird diese auf ihre Vereinbarkeit mit verfassungsrechtlichen und strafprozessualen Grundprinzipien sowie auf ihre Anwendbarkeit im nationalen Strafverfahren untersucht.
