Das Werk untersucht die Ursachen und Ausprägungen des Prinzipal-Agenten-Problems, das bereits im Individualrechtsschutz besteht, und dessen Verschärfung im Kollektivrechtsschutz. Es zeigt mögliche juristische sowie institutionenökonomische Lösungsansätze auf, die bei der Wahl des Anwalts ansetzen, Kontrollmechanismen während des Prozesses durch Geschädigte, Richter oder Dritte vorsehen oder sich auf den Ausbau der öffentlichen Rechtsdurchsetzung fokussieren. Gegenstand der Untersuchung sind die Rechtsordnungen Deutschlands, der USA, Frankreichs, Englands und der Niederlande.
