englischIn contrast to the protection of personality rights in Germany, the Swedish approach in this context is primarily based on penal law supplemented by the application of voluntary self-control by the press.

The comparison of both legal frameworks, the Swedish with the German one, for the protection of personality rights is followed by a discussion of the high financial compensations which the German civil jurisdiction imposes on serve cases of violation of personality rights. These fines intend to have a preventive character.

As conclusion of this work ways will be introduced how ‘de lege ferenda’ legislation in the UWG might strengthen the role of self-control executed by press in Germany. Furthermore it suggests how the conflict between the high financial compensations for violation of personality rights on the one hand and significantly lower compensation for physical suffering on the other hand can be resolved.
