englischThe competition authorities regularly impose record fines against cartel participants. Usually, the affected parties also claim damages, which may even exceed the amount of the fines. European law regards these damages claims not only as compensation for the affected parties, but also as a specific instrument for behavioral control: The claims for damages have the effect of a fine increase through the back door. Considering the double liability, there are increasing warnings of a looming "sanctions overkill". This thesis examines the relationship between both types of sanctions and presents a proposal for a better coordination between fines and damages claims.
