englischOn the occasion of the bi-national project of the SES, the author outlines a conceptual framework for a genuine supranational legal form, which is intended to facilitate SMEs' access to the European internal market.
In this context, the author analyzes the possible additional value of such a legal form and deduces consequences for the concrete design. Finally, the conclusions thus gained are contrasted with the recently published draft for the creation of an SES statute.
Anlässlich des binationalen Projektes der SES skizziert der Autor einen regelungskonzeptionellen Rahmen für eine echte supranationale Rechtsform, die KMU den Zugang zum europäischen Binnenmarkt erleichtern soll.
Dabei analysiert der Autor den möglichen Mehrwert einer solchen Rechtsform und leitet aus diesem Konsequenzen für die konkrete Ausgestaltung ab. Die so gewonnen Erkenntnisse werden schließlich dem kürzlich veröffentlichten Entwurf zur Schaffung eines SES-Statuts gegenübergestellt.
