englischRefusal of military service and its consequences are increasingly the subject of asylum applications in the face of ongoing armed conflicts. The author examines the requirements of granting refugee status to conscientious objectors distinguishing different case groups and taking into account numerous decisions of Anglo-American, European and German courts. She addresses the field of tension between military service as a basic duty and the right of conscientious objection to military service. Furthermore, she elaborates the relationship of international refugee law to international humanitarian law and international criminal law, i.e. embedding refugee law in other areas of public international law.
