englischAgainst the background of the new legislation regarding Preimplantation Genetic Diagnosis (PGD) this study examines whether the new § 3a ESchG allows a legally secure handling of PGD in Germany. A focus is on the question of whether the legislator's objective to allow PGD only within narrow limits could be realized by § 3a ESchG. The work also aims to reflect the debates on PGD with a view to the various disciplines concerned: Despite the legal focus, the approach is therefore an interdisciplinary one. PGD is consequently not only examined from a simple legal perspective, but also from a medical, ethical and constitutional perspective. To approach the status of the embryo in vitro a comprehensive analysis of the legal reality is carried out as is expressed in the legislation protecting prenatal life and in the case law of the Federal Constitutional Court.
