englischPursuant to Article 100 (1) of the Basic Law, German criminal judges are entitled – and may even be obliged – to call upon the Federal Constitutional Court in order to have the constitutionality of particular rules of substantive or procedural criminal law clarified in a binding manner. Against this background, the study analyses the scope of this specific judicial review procedure from the perspective of criminal law. It also sheds a light on the numerous legal issues that are linked the application of Article 100 (1) GG in criminal cases. Overall, the study criticises the current legal framework and therefore submits a detailed proposal for reform.
