englischThe author examines the use of land, a legal subject of existential significance in the Roman Empire as well as today. In an interdisciplinary approach, the author raises three central questions relating to Roman law: What were the most relevant legal forms of land use, and how were they shaped in the context of societal and economic realities? In what way did the Romans practice a legal science? How can the examination contribute to possible solutions for today’s questions on land law and land policy? The answers lead to a well-founded and differentiated understanding of the use of land. They are based on an analysis of the historical legal sources and the writings of the Roman land surveyors.

Der Autor nimmt mit der Nutzung von Land einen rechtlichen Gegenstand in den Blick, der im römischen Reich wie heute von existentieller Bedeutung ist. In einem interdisziplinären Forschungsansatz werden dem römischen Recht drei zentrale Fragen gestellt: Welche Rechtsformen prägten bei den Römern die Nutzung von Land, und wie waren sie im Kontext der gesellschaftlichen und wirtschaftlichen Realität ausgestaltet? Inwiefern betrieben die Römer hierbei eine Rechtswissenschaft, die uns heutigen Betrachtern nützliche oder inspirierende Ideen vermittelt? Welche Bezüge und Lösungsansätze zu aktuellen Themen des Bodenrechts und der Bodenpolitik erkennen wir? Die Antworten auf diese Fragen leisten einen Beitrag zu einem historisch fundierten und dogmatisch differenzierten Verständnis der Nutzung von Land. Sie basieren überwiegend auf einer Auswertung sowohl der juristischen Quellen als auch der Schriften der römischen Feldmesser.
