englischThe dissertation addresses the conflicts between the majority and minority lists formed for the purpose of the Works Council election. The majority list can exclude the members of minority lists from parts of the Works Council’s work by using organizational tricks. Case law only applies the limit of an abuse of rights. But how far should the dominance of the majority go when internal decisions are concerned? The legal status of minority lists is revaluated, especially with regard to the requirements of a coalition (art. 9 para 3 GG). As a consequence, a minimum standard of minority protection is developed that ensures the working ability of the minority lists. Furthermore, the dissertation offers solutions for problematic organizational constellations such as the allocation of working materials or the regulation of the size of committees.
