englischThe EU as well as its member states concurrently attempt to resolve the problem of enforcing deportations by concluding readmission agreements with refugees’ and migrants’ countries of origin and with so called safe third countries. After portraying and analyzing the to date 17 readmission agreements concluded by the EU, the question if member states still have the right to legally conclude readmission agreements on their own without the EU’s consent is examined by exploring the division of competence between the EU und its member states.

Thus, an objective answer to one of the most politicized problems concerning the current refugee crisis is introduced based on legal arguments instead of politically motivated reasoning.
