The author analyses the various terms of Art. 3 Directive 2006/116/EC, which was last amended by Directive 2011/77/EC and their implementation to national German law. The work focuses on the duration of the exploitation rights; in this context, the discrimination of performers, whose performance was not first fixed in a sound recording, will be discussed. The examination of the Directive and its transposition is based on German Copyright Law, a number of copyright legal directives and international treaties, such as the WPPT, the Rome Convention and the WIPO Treaty On Audiovisual Performances (BTAP).
Die Dauer der Verwertungsrechte der Tonträgerhersteller und derjenigen ausübenden Künstler, deren Darbietung auf einem Tonträger festgelegt wurde, sind durch die fristgemäße Umsetzung der Schutzdauerrichtlinie 2011/77/EU von 50 auf 70 Jahre verlängert worden.
Die Autorin analysiert die Bestimmung des Art. 3 der Schutzdauerrichtlinie 2006/116/EG, welche zuletzt durch die Richtlinie 2011/77/EU geändert wurde, und deren Umsetzung in nationales, deutsches Recht. Der Schwerpunkt der Untersuchung liegt auf der Beurteilung der Dauer der Verwertungsrechte der ausübenden Künstler und Tonträgerhersteller und die dabei zutage tretende Diskriminierung der ausübenden Künstler, deren Darbietung nicht auf einem Tonträger festgelegt wurde. Die Kritik und Auslegung der Richtlinie erfolgen anhand des nationalen Urheberrechtsgesetzes, zahlreicher zum Urheberrecht ergangener Richtlinien und völkerrechtlicher Verträge, wie des WPPT, des Rom-Abkommens und des WIPO-Vertrages zum Schutz audiovisueller Darbietungen (BTAP).
