englischThe so called ‘Dublin III Regulation’ lays down the criteria and mechanisms for determining the Member State responsible for examining an application for asylum lodged in one of the Member States by a third-country national.

Large numbers of applications for asylum are annually lodged in Germany. In each of those cases arises the question whether there is an obligation to examine an application or whether the asylum seeker can be transferred to another ‘Dublin state’.

The author points out that the German authorities have to ensure full observance of fundamental and human rights when applying the Dublin III Regulation. From this follows that in certain situations obligations to examine applications exist that can be enforced by asylum seekers before national courts. Furthermore the author states that the German ‘concept of save third country’ can not be invoked in Dublin cases.
