englischVehicles are full of sensors and thus full of data. In the case of an accident, temptations to use these data to battle the burden of proof are ever growing. This study outlines the possibilities and limits of accident data usage in civil procedure. The study opens by outlining the technical framework of data in road cars to give solid foundations for legal evaluation. The author proceeds by analysing the question of whether the vehicles owner may demand the release of accident data from Original Equipment Manufacturer. She finds the basis for such an informational action to be Art. 15 GDPR. The following section examines issues of evidence procedure under Sec. 371 et seq. German Code of Civil Procedure. The author emphasizes fundamental issues of data ownership and claims and counterclaims for the other parties vehicle data. With a view to the cars of the future and the large amount of vehicle accident claims, the study is dedicated to current and practical issues of legal application.
