englischIn recent years, the protection of fundamental rights has noticeably gained in importance in France and is now one of the central tasks of the courts. The primary driving forces behind this development were the jurisprudence of the European Court of Human Rights as well as comparative law.

The first part of the book analyses the powers of the Conseil constitutionnel and the French courts with regard to the protection of fundamental rights. It outlines the historical development of the judicial protection of fundamental rights in France before the relevant judicial procedures are described in detail.

The second part of the book describes the conceptual development of the protection of fundamental rights in France, analyses the French terminology and highlights central aspects of French substantive law.
