englischIn recent years, the protection of fundamental rights has noticeably gained in importance in France and is now one of the central tasks of the courts. The primary driving forces behind this development were the jurisprudence of the European Court of Human Rights as well as comparative law.
The first part of the book analyses the powers of the Conseil constitutionnel and the French courts with regard to the protection of fundamental rights. It outlines the historical development of the judicial protection of fundamental rights in France before the relevant judicial procedures are described in detail.
The second part of the book describes the conceptual development of the protection of fundamental rights in France, analyses the French terminology and highlights central aspects of French substantive law.
Der Schutz der Grundrechte hat in Frankreich in den letzten Jahren spürbar an Kontur gewonnen und zählt mittlerweile zu den zentralen Aufgaben der Gerichte. Die primären Triebkräfte dieser Entwicklung waren der europäische Grund- und Menschenrechtsschutz sowie die Rechtsvergleichung.
Der erste Teil der Arbeit zeigt auf, welche Befugnisse dem Conseil constitutionnel sowie den französischen Fachgerichten mit Blick auf den Grundrechtsschutz zukommen. Zu diesem Zweck wird die historische Entwicklung des gerichtlichen Grundrechtsschutzes in Frankreich nachgezeichnet, bevor die grundrechtsrelevanten Verfahren vor dem „Verfassungsrat“ und den Fachgerichten im Einzelnen dargestellt werden.
Der zweite Teil der Arbeit zeichnet die konzeptionelle Entwicklung des französischen Grundrechtschutzes vom Schutz durch das hin zum Schutz vor dem Parlamentsgesetz nach, analysiert die französische Grundrechtsterminologie und untersucht die zentralen Aspekte der französischen Grundrechtsdogmatik.
