englischUpper age limits are distinctive of German civil service law. Whilst the prohibition of age discriminiation under European Union law has had significant influence on labour law, civil service law seemed to remain unaffected. However, due to the case “Kreil”, the impact of EU anti-discrimination law on national civil service law is now beyond question.

The thesis contributes to the development of civil service law as laid down in Art. 33 Par. 5 GG by reviewing the age limits framing the career of every civil servant: The upper age limits for the recruitment and the retirement of civil servants in German civil service law are examined in terms of their compatibility with German constitutional and European Union law, and the results are transferred into proposed regulations. Finally, a brief excursus covers aspects of age limits for certain municipal officials.
