englischBecause of the exhaust emission scandal involving Volkswagen and the attack on Borussia Dortmund’s team bus, among other things, the issue of market manipulation has received increased public scrutiny. But why has such behaviour entailed only criminal and administrative consequences so far but has not been punished in the civil law courts? In this study, the author raises this question and analyses if and how the prohibition of market manipulation, which is now embedded in EU law, can be enforced by the instruments of civil law. In contrast to many of the works that have been published on this topic, this study does not stop at the question of the necessity of an appropriate basis for such claims, but instead develops proposals for a detailed concept of liability in this regard.
