By applying a normative meta-perspective, this thesis provides a comprehensive analysis of the doctor-patient relationship concerning health-related information. The author analyses the highly complex legal framework that regulates the flow of medical information between a doctor and a patient from the point of view of information law. He therefore explores various areas of civil, criminal and public law and discusses underlying legislative considerations. In doing so, he focuses on conflicting interests regarding information - i.e. access and restriction rights - and addresses questions of informational justice and sovereignty. All in all, this thesis contributes to the theory of information law by emphasising structural and normative similarities between information law in general and health-related law in particular.
Das Informationsrecht als Recht der Informationsbeziehungen: Am Beispiel der Rechtsbeziehung zwischen Arzt und Patient untersucht das Werk erstmals den Umgang mit Gesundheitsinformationen aus einer informationsrechtlichen Metaperspektive. Dazu verknüpft der Autor verschiedene Rechtsgebiete, darunter insbesondere das Behandlungsvertrags-, Datenschutz- und Strafrecht.
Den Schwerpunkt der Untersuchung bildet eine umfassende Analyse des hochkomplexen Rechtsrahmens, der die Zuordnung und den Austausch von Gesundheitsinformationen im Arzt-Patienten-Verhältnis bestimmt. Dabei werden materienübergreifende Regelungsstrukturen herausgearbeitet, widerstreitende Zugangs- und Restriktionsinteressen beleuchtet und Fragen der Informationsgerechtigkeit erörtert. Zugleich stellt der Autor systematische Querbezüge zur Theorie des allgemeinen Informationsrechts her und gelangt zu dem Ergebnis, dass das Medizininformationsrecht als „Informationsrecht BT“ verstanden werden kann.
Die Arbeit wurde mit dem Wissenschaftspreis der Gesellschaft für Datenschutz und Datensicherheit e.V. (GDD) ausgezeichnet.
