englischDespite legislative efforts, instances of gender inequality can still be identified in public services. In this this study and referring hereto, the author applies the prohibition of indirect gender discrimination to abstract test cases.

Even 45 years after its first application by the European Court of Justice, the legal concept of indirect discrimination raises a wide range of issues that are relevant in practice. Basing this study on an analysis of legal sources, the author considers these issues and clarifies the prohibition of indirect gender discrimination in public services. By examining legal norms in the employment fields of school and science, the author uncovers the causes of gender-specific discrimination created by the law and scrutinises their lawfulness. In this regard, she particularly criticises the employment conditions and salaries of Hessian primary school teachers.
