englischThis dissertation deals with a subject that is of particular importance for the practice of both law and business: Public-Private Partnerships (PPP). The tension between public interests on the one hand and those of the private sector on the other affects each implementation of PPP. This results in numerous legal and economic problems, as well as a multitude of interesting questions. The present work attempts to investigate this field of tension comprehensively, to point out legal problems and propose appropriate solutions. The core of this comparative legal analysis is the question of the extent to which the development of PPP in Germany and Turkey has led to a legal scientific permeation or even to a codification in both countries. The findings of the work are of interest to both academics and practitioners in the context of PPP.
Die vorliegende Dissertation beschäftigt sich mit einem Thema, das hochaktuell und von besonderer Bedeutung für die wirtschaftsjuristische Praxis ist: Public Private Partnerships (PPP). Das Spannungsfeld von Interessen der öffentlichen Hand auf der einen Seite und von solchen der Privatwirtschaft auf der anderen bestimmen jede PPP. Daraus ergeben sich zahlreiche rechtliche wie ökonomische Probleme und eine Vielzahl interessanter Fragen. Mit der vorliegenden Arbeit wurde der Versuch unternommen, dieses Spannungsfeld umfassend zu untersuchen, insoweit die rechtlichen Problemstellungen aufzuzeigen und entsprechende Lösungsansätze vorzuschlagen. Im Mittelpunkt der rechtsvergleichenden Untersuchung steht die Frage, in wieweit die Entwicklung von PPP in Deutschland und in der Türkei zu einer rechtswissenschaftlichen Durchdringung oder sogar zu einer Kodifikation in beiden Ländern geführt hat. Die Erkenntnisse der Arbeit richten sich gleichfalls an Akademiker wie Praktiker im Kontext von PPP.
