After the events of Stuttgart 21 and Fukushima, the promotion of public acceptance and procedural efficiency are the primary (and yet contrary?) objectives for the legislator in the context of the German turnaround in energy policy. Increased public participation is seen as a crucial factor in this regard.
The author analyses the different forms and functions of public participation and carves out the underlying political concept for each procedural stage. Implementation deficiencies are identified and met with corresponding amendment proposals. The European TEN-E regulation No. 347/21013 introduces further requirements on a European level. The study analyses the conformity of the national procedural law with the regulation and proposes concrete solutions for the harmonization of the various rules of procedure.
Der Band beinhaltet eine umfassende Analyse des grunderneuerten Verfahrensrechts für den Übertragungsnetzausbau. Nach Stuttgart 21 und Fukushima stellen sich im Rahmen der Energiewende Akzeptanzförderung und Verfahrensbeschleunigung als primäre (und zugleich konträre?) Zielsetzungen des Gesetzgebers dar. Zentrales Instrument hierfür soll die Ausweitung der Öffentlichkeitsbeteiligung sein.
Auf jeder Verfahrensstufe analysiert der Autor die verschiedenen Formen und Funktionen der Öffentlichkeitsbeteiligung und arbeitet das gesetzgeberische Konzept heraus sowie Mängel in der jeweiligen Umsetzung. Letztere führen zu zahlreichen Anpassungsvorschlägen. Daneben stellt die TEN-E-Verordnung Nr. 347/2013 für den Übertragungsnetzausbau unionsrechtliche Anforderungen auf. Die Studie analysiert die Vereinbarkeit des nationalen Verfahrensrechts mit dieser Verordnung und macht auch insoweit konkrete Vorschläge, um die jeweiligen Verfahrensvorgaben zu harmonisieren.
