Such cuts can occur when the regulatory authorities class an item on the assets side of a company’s balance sheet as not necessary for running a business and yet assess a corresponding item on the liabilities side of the balance sheet to be non-interest-bearing. Until now there has not been a consistent economic and legal concept of how we can determine what constitutes the capital necessary for running a business in such cases. This study aims to contribute to the development of such a concept. It is based on two expert reports compiled on behalf of E.ON.
Im Rahmen der Identifikation des betriebsnotwendigen Eigenkapitals nach § 7 Abs. 1 GasNEV/33 StromNEV ist umstritten, inwiefern asymmetrische Kürzungen zulässig sind. Diese entstehen dann, wenn die Regulierungsbehörden eine Vermögensposition auf der Aktivseite als nicht betriebsnotwendig einstufen, eine korrespondierende Gegenposition auf der Passivseite als Abzugskapital jedoch ungekürzt ansetzen. Was bislang fehlt, ist ein stimmiges Konzept aus wirtschafts- und rechtswissenschaftlicher Sicht, wie das betriebsnotwenige Eigenkapital in diesen Fällen zu bestimmen ist. Die Untersuchung soll einen Beitrag zur Schließung der konzeptionellen Lücke leisten. Sie geht auf zwei Gutachten zurück, die im Auftrag der E.ON SE erstellt wurden.
