englischIn 2014 the German legislator passed a new Act on Renewable Energies. On this basis, the book examines the constitutional framework for the support of renewables in Germany. It scrutinizes the compatibility of the German support mechanism with constitutional fiscal and tax law and fundamental rights with respect to the system operator’s obligation to connect renewable energy plants, the market premium for electricity from renewable sources, the consumers‘ obligation to contribute to the support mechanism and the adjustment of feed-in tariffs. Particular emphasis is placed on more theoretical aspects of the dicussion.

In this respect the book touches on inter alia the implications of fiscal and tax law for fundamental rights law, multilateral collisions of fundamental rights, the legal position of competitors as to competitive disadvantages induced by state aid, the infringement of legitimate expectations by legislative deadlines and the state’s recourse to private parties for public policy purposes.
