englischThe author seeks a new approach to the contract of deposit in Roman law from the perspective of duties. This results in new approaches to the interpretation of the contradictory sources on the duties and liability of the depositary as well as to the resolution of conflicts of duties. Using the example of deposit, he presents a study that analyzes our largely Late Classical tradition as a product of compromises between different legal doctrines that have their basis in the late Republic and the various philosophical influences on Roman jurists. Also shown is the persistence of the various Roman legal doctrines in German and European law.
