englischThe topic of nuclear disposal has been treated in juridical regard up to now only rudimentary. To this day the federation has not met the legal obligation existing for roughly 40 years to set up a plant for the safekeeping and for the permanent ­storage of highly-radioactive waste. Repeatedly changed disposal-­conceptual approaches have contributed perpetually to a ­temporal shift of the “dumping question” into an uncertain future. Against this background it seems necessary on to examine whether such a “politics of ephemeral solution attempts” is legally to be accepted (any longer). Hence, including the recently remitted site selection law the author works out extensively the removal regime applying in Germany for highly radioactive long-lasting rubbish and verifies his compatibility with the European law, the German constitutional law and the ­thematically relevant International treaty law.
