Die Autorin stellt diese Prozesse in den Kontext prinzipieller Betrachtungen, insbesondere zum Unternehmensbegriff, zu Begründung und Reichweite unternehmerischer Verantwortung und zu Public-Private Governance. Dabei wird deutlich, dass die Informalisierung der Normbildung und ihre Verlagerung auf Exekutiven und private Akteure grundsätzliche Fragen nationaler Souveränität, demokratischer Legitimation und Rechtsstaatlichkeit aufwerfen und eine neue Definition von „Recht“ fordern.
