Beside Smart Meter systems complex, iac based operating facilities will be established for buildings in the long term. The realization of „Smart Home“ concepts are eligible. Simultaneously they go hand in hand with certain risks. The research investigates the legitimacy of data processing and depicts civil law probems that might arise relating to the sale, the utilization and the rental of Smart Homes. In this connection the research provides special attention to the questions, whether – and to what extent – Smart Homes fall into the scope of the guarantee of the cofidentiality and integrity of information technology systems and which objective law effects this circumstance develops to the researched regulations. The study ends up with a exemplary set of legal based design proposals to avoid and reduce the risks.
