englischThe Grundstückverkehrsgesetz (law of real estate transactions) provides the legal framework for the transfer of agricultural land plots. Against the background of increased purchase prices on the agricultural land market, concentration processes in agriculture and an increasing demand from non-agricultural investors, the legal framework for real estate transactions has become the focus of legal policy debate. At the same time, the regulation of agricultural real estate transactions has increasingly moved into the focus of European jurisdiction.
The dissertation takes up these developments by, for the first time, systematically examining the compatibility of the existing legal framework with fundamental freedoms and state aid law, and by analysing and developing reform proposals for dealing with conflicts on the land market, including European law and constitutional requirements, as a suggestion for the design of the de lege ferenda Grundstückverkehrsgesetz.
Die Arbeit wurde mit dem 2. Preis des Promotionspreises der DGAR ausgezeichnet.
Das Grundstückverkehrsgesetz bildet den Rechtsrahmen für die Übertragung landwirtschaftlicher Grundstücke. Vor dem Hintergrund gestiegener Kaufpreise am landwirtschaftlichen Bodenmarkt, Konzentrationsprozessen in der Landwirtschaft und einer steigenden Nachfrage außerlandwirtschaftlicher Investoren ist der Rechtsrahmen zum Grundstücksverkehr in den Mittelpunkt rechtspolitischer Diskussion getreten. Parallel hierzu ist die Regulierung des landwirtschaftlichen Grundstückverkehrs vermehrt in das Blickfeld der europäischen Gerichtsbarkeit gerückt.
Die Arbeit greift diese Entwicklungen auf, indem sie erstmals sowohl die Vereinbarkeit des bestehenden Rechtsrahmens mit den Grundfreiheiten sowie dem Beihilferecht umfassend systematisch untersucht als auch Reformvorschläge zur Bewältigung der Konflikte am Bodenmarkt unter Einbeziehung unions- und verfassungsrechtliche Maßgaben als Anregung für die Ausgestaltung des Grundstückverkehrsgesetzes de lege ferenda analysiert und entwickelt.
