englischDoes criminal culpability exist in a deterministic world? Many neuroscientists deny this and promote an exclusivly preventive criminal law. Yet, since antiquity philosophers called ‘compatibilists’ argue for a reconciliation of determinism and culpability and attempt to prove that we are responsible for our decisions and actions even in a pre-determined world, while ‘incompatibilists’ continue to reject compatability of culpability with determinism. This contribution to the philopshopy of criminal law analyzes the extensive philosophical literature and adapts for a jurisprudential discussion. At the same time, it puts neuroscience in its place, showing that there is no such thing as a “brain-compatible” law. Yet, there is law that is based on established ethics and legal principles.
Gibt es „Strafrechtliche Verantwortung in einer determinierten Welt“? Viele Hirnforscher verneinen dies und plädieren für ein reines Schutzstrafrecht. Doch seit der Antike gibt es Philosophen, die „Kompatibilisten“, die für eine Vereinbarkeit von Determinismus und Verantwortung plädieren und zu belegen versuchen, dass wir auch in einer vollständig determinierten Welt für unsere Entscheidungen und unser Handeln verantwortlich sind. Dagegen bestreiten die „Inkompatibilisten“, dass moralische Verantwortung und Determinismus miteinander kompatibel sind.
Dieses strafrechtsphilosophische Werk wertet die umfangreiche philosophische Literatur zu dem Streit aus und macht sie anschlussfähig für eine rechtswissenschaftliche Diskussion. Die Untersuchung weist damit zugleich die Hirnforschung in ihre Schranken: Ein hirnkompatibles Recht gibt es nicht. Aber es gibt ein Recht, dass begründeten ethischen Grundsätzen und Prinzipien Rechnung trägt und mit der These des Determinismus kompatibel ist.
