englischThe management of economic crime notably illustrates the transformation processes of liberal communities in which the state constantly strives to fulfil novel regulation expectations. According to the logic of free markets and the close connection of economy and public welfare, this development in the field of tension between society, crime and state intervention has acquired a previously unknown dynamic. In order to be able to classify the transformation of commercial criminal law, it is therefore insufficient to merely measure the status quo of modern crime control. It only becomes comprehensible when confronted with insights from economic and social history, criminal sociology and criminal legal philosophy. Only then will it become evident that the current practice of economic conflict management points to underlying issues which concern the status of the subject as well as forms of value creation and the theoretical basis of the existing regulations.
