englischWhat is UNESCO's contribution to internet governance with its concepts of the information and knowledge societies, and is this activity relevant under international law? This study evaluates selected UNESCO instruments from a human rights perspective and examines them on the basis of innovative approaches to the legal scope of governance phenomena. It also addresses the question of guaranteeing legitimacy and the rule of law in the application of non-legally binding and non-legal instruments in internet governance. This study is essentially oriented towards international law, but its conceptual foundations are supplemented by the approaches of governance research and thus also offer an interdisciplinary perspective.
Wie leistet die UNESCO mit ihren Konzepten zur Informations- und Wissensgesellschaft einen Beitrag zur Internet Governance und ist dieses Handeln von völkerrechtlicher Relevanz? In der Abhandlung werden ausgewählte UNESCO-Instrumente aus menschenrechtlicher Sicht bewertet und anhand innovativer Ansätze zur rechtlichen Erfassung von Governance-Phänomenen beleuchtet. Dabei geht es auch um die Frage der Gewährleistung von Legitimation und Rechtsstaatlichkeit bei der Anwendung nicht rechtsverbindlicher und nicht rechtsförmiger Instrumente in der Internet Governance. Die Untersuchung ist im Kern völkerrechtlich ausgerichtet, jedoch wird sie in ihren konzeptionellen Grundlagen durch die Ansätze der Governance-Forschung ergänzt und bietet somit auch eine interdisziplinäre Sichtweise.
