It shows why social scientific perspectives on law are constitutive both for a successful practice of law and the scientific foundations of legal studies. It outlines elements of a social theory of human rights and constitutional orders to provide a well-reflected base to protect them against populist (and other) political attacks. To this end, the book further develops a fundamental question of the social theory of modernity: How can one explain the global success of human rights and constitutional orders? How can contemporary threats be explained? Does a social theory of law provide the means to defend basic elements of the liberation of human beings through their own action by human rights and democratic constitutional orders against apathy and political attempts to destroy them?
