The thesis shows that the doctrine of objective imputation offers a viable restriction approach for the offense of embezzlement and is therefore of particular interest to both practitioners and academics. It breaks new ground in the dogmatics of objective imputation and the offence of embezzlement. At the heart of the thesis lies the elaboration of a doctrine of risk creation. Risk creation centers on the insight that only a risk that exceeds the ever-present risk can be relevant under criminal law. Whether such an exceeding risk exists must be examined using the criterion of planned avoidability. The study also discusses questions of legal disapproval, the realization of risk, the delimitation of areas of responsibility and immediacy.
