Informationelle Selbstbestimmung zwischen Datenschutz- und Vertragsrecht

This paper contributes to the clarification of the interplay of complex data protection and contract law issues that arise from the use of personal data as consideration in digital business models. In addition to the question of the existing implications of data protection law for the contractual categorisation of such business models, the study examines in particular whether and how contract law provides instruments to counteract certain manifestations of an existing market failure in online business models. The work contains corresponding proposals for implementing and supplementing the existing legal framework.
