Description
The legally compliant implementation of collective redundancies has become increasingly difficult in recent years due to the influence of EU law. Due to numerous verdicts (e.g. Junk verdict, Air Berlin verdicts) and the associated new understanding of collective redundancy law, the requirements set out in the current Sec. 17 and 18 KSchG are outdated and do not adequately reflect the influence of EU law. On the basis of current problems in collective redundancy law, the dissertation therefore examines the question of the extent to which the current legal situation and case law exceed the limits of interpretation in conformity with the Directive and whether Sec. 17, 18 KSchG should therefore be reformed.
