Description
The work develops guidelines to the legislator for the regulation of species protection assessments during the planning of wind turbines in so-called “acceleration areas” under "RED III". The single permit-oriented regulation of bird strikes on wind turbines, in particular through the so-called “significance theorem”, is subjected to fundamental criticism. Three "pillars" of improved federal regulation when implementing RED III, including the associated “uplifting” of species protection assessments to the planning stage, are formulated: (1) A fundamental legislative decision on the level of protection; (2) the region-wide use of mitigation measures and (3) the making available of reliable, region-wide data.
