Die Nutzung von Cloud Computing stellt das Recht vor erhebliche Schwierigkeiten. Unabhängig vom tatsächlichen Speicherort ist der Zugriff auf Daten in der Cloud über das Internet von überall möglich. Das Buch „Cloud Computing und staatlicher Strafanspruch“ untersucht zum einen strafrechtliche Risiken, die dadurch entstehen, dass die Daten in der Cloud für jedermann einsehbar sind. Zum anderen werden die strafprozessualen Ermittlungsmöglichkeiten beim Cloud Computing innerhalb der Grenzen der Strafprozessordnung dargestellt. Schließlich stellt die Verfasserin Gestaltungs- und Handlungsempfehlungen für die Cloud-Anbieter und Cloud-Nutzer dar und zeigt damit einen Weg zur strafrechtssicheren Nutzung von Cloud Computing auf.

The book “Cloud Computing and the State’s right to punish” on the one hand examines potential criminal risks arising from unrestricted accessibility of data stored in the cloud. On the other hand it outlines the means of penal investigation in this context within the limits of the German code of criminal procedure. In addition the author provides recommendations of both, action and organization, for cloud providers and users in order to present a road map for the secure usage of cloud services.
