Diese Dissertation gibt Ihnen einen vertieften Einblick in die Gesetzeslage zum Erfolgshonorar bis zum 01.10.2021 und einen Ausblick auf die Gesetzesänderung ab Oktober 2021. Thematisiert wird insbesondere, unter Berücksichtigung der ökonomischen Analyse, das Spannungsverhältnis des Rechtsanwaltes bezüglich der Durchsetzung der Rechte seines Mandanten, der Einhaltung des (Berufs-)Rechts und der Wahrung seiner eigenen Interessen. Zudem wird die rechtliche Einordnung sog. Inkassodienstleister und gewerblicher Prozessfinanzierer untersucht.
englischThis dissertation provides an intensive insight into the legal situation regarding the contingency fee until 01.10.2021 and an outlook on the change in the law as of October 2021. The subject of the dissertation is, in particular, the conflicting relationship of the lawyer with regard to the enforcement of his client's rights, compliance with (professional) law and, in particular, the protection of his own interests, taking into account the economic analysis. In addition, the legal classification of so-called collection service providers and commercial litigation financiers will be examined.
