Based on a europe-wide uniform qualification method the work explores the law applicable to insolvency avoidance in accordance with Art. 7 II lit. m), 16 of the European Insolvency Regulation.
The work is based on a detailed investigation of the purpose of these provisions. On this basis, the scope of application is determined as well as the interpretation of the wording of Art. 16 of the European Insolvency Regulation “no means of challenging that act in the relevant case”.
