Jeder fünfte Rechtsanwalt bzw. Rechtsanwältin übt neben dem klassischen Anwaltsberuf noch einen Zweitberuf aus (z.B. Notar:in, Insolvenzverwalter:in, Steuerberater:in, Unternehmensberater:in). Da es zwischen dem Anwalts- und dem Zweitberuf zu Interessenkollisionen kommen kann, verbietet das anwaltliche Berufsrecht ein Tätigwerden als Anwalt, wenn dieser mit derselben Angelegenheit bereits in einem anderen Beruf vorbefasst war (§ 45 Abs. 1 BRAO), sowie ein zweitberufliches Tätigwerden bei einer anwaltlichen Vorbefassung (§ 43a Abs. 6 BRAO). Die Arbeit analysiert die Reichweite, den Schutzzweck und auch die Grenzen der Tätigkeitsverbote der §§ 43a Abs. 6, 45 BRAO und geht dabei auf zahlreiche Zweitberufe ein.
englischEvery fifth attorney in Germany practices a second profession (e.g. notary, insolvency administrator, tax consultant). Since conflicts of interest can arise between the attorney's profession and the secondary profession, the BRAO (Federal Lawyers' Act) prohibits attorneys from practicing as an attorney if he or she has already been involved in the same matter in another profession (Section 45 (1) BRAO), as well as from acting as a secondary professional if he or she has already been involved as an attorney (Section 43a (6) BRAO). The dissertation analyses the scope, the purpose and the limits of the bans on professional practice under Sections 43a (6), 45 BRAO and deals with numerous secondary professions.
