Ist eine einheitliche europäische Äquivalenzlehre im Lichte des jüngsten Urteils des UK Supreme Court in der Sache Actavis v. Eli Lilly in greifbare Nähe gerückt? Die rechtsvergleichend angelegte Arbeit zeichnet die Entwicklung der Schutzbereichsdogmatik in Deutschland und dem Vereinigten Königreich anhand der jeweiligen Präzedenzfälle nach und untersucht, ob ein gemeinsames Fundament für eine einheitliche Äquivalenzlehre in den beiden wichtigsten Patentjurisdiktionen Europas gegeben ist. Sie befasst sich insbesondere mit den zwei umstrittenen und für die Praxis sehr relevanten Problemkreisen des „Prosecution History Estoppel“ sowie der sog. Auswahlentscheidung und macht einen Vorschlag für eine Reform des EPÜ.

Taking a comparative approach, the thesis outlines the development of case law on the scope of patent protection in Germany and the United Kingdom by looking at the respective precedents and examines whether there is a common foundation for a uniform doctrine of equivalence in the two most important patent jurisdictions in Europe. It deals in particular with the two controversial and for practitioners very relevant problem areas of the "prosecution history estoppel" as well as the so-called selection decision and makes a proposal for a reform of the EPC.
