Die immateriellen Interessen eines Kulturguteigentümers werden mangels geeigneter zivilrechtlicher Normen nicht ausreichend geschützt. Insbesondere führt die 30-jährige Verjährungsfrist bei Kulturgütern nicht zu sachgerechten Lösungen. Durch die Vindikationsverjährung verbleibt in der Hand des Eigentümers nur ein nudum ius, welches auch nach 30 Jahren einen unzureichenden Schutz für das Kulturgut darstellt. Eine verfassungskonforme Auslegung der Vindikationsverjährung scheitert am klaren Willen des BGB-Gesetzgebers.
Die Arbeit untersucht, inwiefern de lege lata und de lege ferenda der gutgläubige Erwerb, die Ersitzung sowie die Verjährung von abhanden gekommenen Kulturgütern im Sinne des § 2 Nr. 1 KGSG eingeschränkt werden kann.

In particular, the 30-year limitation period for cultural property is not an appropriate solution. Due to the statute of limitations, only a nudum ius remains in the hands of the owner, which represents an insufficient protection for the cultural property even after 30 years. A constitutional interpretation of the vindication limitation fails due to the clear intention of the BGB legislator.
The thesis examines to what extent de lege lata and de lege ferenda the bona fide acquisition, acquisitive prescription as well as the limitation of lost cultural property in the sense of § 2 No. 1 KGSG can be restricted.
