In der Rechtspraxis schließen Verbraucher vermehrt zusammen mit einem Darlehensvertrag einen Restschuldversicherungsvertrag ab. In der Regel handelt es sich hierbei um verbundene Verträge im Sinne des § 358 Abs. 3 BGB. Eine Besonderheit verbundener Verträge ist darin zu sehen, dass der Widerruf des einen Vertrags auf den damit verbundenen Vertrag erstreckt wird (Widerrufsdurchgriff).
Die Arbeit beschäftigt sich mit der Frage, inwiefern ein Widerrufsdurchgriff in dieser Konstellation stattfindet. Zum einen untersucht der Autor, ob der Widerruf des Restschuldversicherungsvertrags auf den damit verbundenen Darlehensvertrag durchgreift. Zum anderen analysiert der Autor, ob und wie ein Widerruf im Falle dreier mittelbar miteinander verbundener Verträge wirkt. Ein solch mittelbarer Verbund von drei Verträgen besteht dann, wenn das Darlehen einerseits der Finanzierung eines weiteren Leistungsvertrags und andererseits der Finanzierung des Restschuldversicherungsvertrags dient.

In the majority of the cases, these contracts are linked contracts in terms of section 358 of the German Civil Code (contracts linked to the contract from which the consumer has withdrawn).
The dissertation addresses issues about the right of withdrawal in consumer contracts in case of linked contracts. On the one hand, the author examines if the consumer is obliged to the consumer loan agreement after he has effectively withdrawn his declaration of intent to enter into a residual debt insurance contract. On the other hand, the author takes a look at the questions concerning the withdrawal of a contract for the supply of goods or for the provision of a service by a trader which is linked to a consumer loan agreement while the loan contract is otherwise linked to a residual debt insurance contract.
