Das Werk überprüft, ob die Rechtsprechung der Tatsachen- und Obergerichte zur Gruppenverfolgung einheitlich ist, bzw. warum und mit welchen Auswirkungen für die Qualität dieser Rechtsprechung von einer Einheitlichkeit abgewichen wird. Zusammenfassend erscheint die Ausweitung der Befugnisse des BVerwG kein Allheilmittel zu sein, um mögliche Defizite zu schließen. Die Autorin kommt zum Ergebnis, es wäre unverhältnismäßig und daher unvernünftig, auf eine derart drastische Maßnahme zurückzugreifen, ohne zuvor die wahren Wurzeln des Problems zu behandeln. Abschließend werden einige Lösungsvorschläge zur Kompetenzerweiterung des BVerwG formuliert.
englischIn this work, the case law of the factual and higher courts on group prosecution is analyzed. The thesis examines the uniformity or lack thereof in case law on group persecution, the reasons behind this, and its effects on the quality of this species of case law. The author comes to the result that the expansion of authority of the Federal Administrative Court is not a remedy for closing possible deficits. It would be disproportionate and, therefore, impertinent to resort to such a drastic measure without first addressing the real roots of the problem. In light of this, alternative solutions are proposed.
