„Eine Theorie ohne Gegenstand, die Theorie eines Phantoms“, so lautet der Vorwurf gegenüber der Prinzipientheorie. Diese wird aufgrund ihrer intuitiven Plausibilität und analytischen Erklärungskraft neben der Grundrechtsdogmatik in verschiedensten Bereichen des Rechts zur Rekonstruktion von Abwägungsprozessen angewandt. Der genannte Einwand betrifft das normtheoretische Fundament der Prinzipientheorie, die Unterscheidung zwischen Regeln und Prinzipien, und stellt daher eines der wichtigsten Probleme der Prinzipientheorie dar.
Dieses Werk entwickelt anhand der Struktur des idealen Sollens, das bereits in den Konzeptionen Alexys und Sieckmanns zu finden ist, eine Prinzipienkonstruktion, die Nachteile bisheriger Konstruktionen überwindet. Hierbei werden Prinzipien als ideal gesollte, wertbezogene Zielbestimmungen interpretiert, womit eine normtheoretische Basis rechtlicher Abwägungsentscheidungen geliefert und den erwähnten normtheoretischen Einwänden begegnet werden kann.

Besides dogmatics of basic rights, this theory is applied in various fields of law because of its intuitive plausibility and analytical explanatory power to reconstruct balancing decisions. The objection mentioned is related to the norm-theoretical fundament of the principles theory, the distinction between rules and principles, and, therefore, represents one of the most important problems of the principles theory.
In this dissertation, a structure of principles is developed on the basis of the ideal ought solving problems of previous conceptions. Principles are interpreted as ideal obligated, value-related goals. Thus, a norm-theoretical basis of legal balancing processes is provided, and the norm-theoretical objections mentioned above are met.
