Die sogenannte Rückführungsrichtlinie, die die Rückführung illegal aufhältiger Drittstaatsangehöriger regelt, wurde nach ihrem Erlass von zahlreichen Menschenrechtsorganisationen und Regierungen insbesondere im Hinblick auf die Einhaltung der Menschenrechte kritisiert.
Die Autorin geht dieser Frage nach und untersucht, ob die Kritik an der Richtlinie begründet ist und ob die Rückführung illegal aufhältiger Drittstaatsangehöriger nach der Rückführungsrichtlinie den geltenden Menschenrechten entspricht.
Sie analysiert die Rechtsprechung des EuGH und des EGMR im Hinblick auf die Rechte irregulärer Migranten im Rückführungsverfahren, zeigt rechtliche Verstöße gegen die Menschenrechte auf und macht auf Schutzlücken im Rückführungsverfahren nach der Rückführungsrichtlinie aufmerksam. Im Ergebnis wird deutlich, dass irregulären Migranten im Rückführungsverfahren zahlreiche Rechte zustehen, die mit der Rückführungsrichtlinie defizitär verwirklicht wurden und deren Durchsetzung für die irregulären Migranten vielfach ein unüberwindbares Hindernis darstellt.
