Das Verbot, zweimal wegen derselben Tat verfolgt oder bestraft zu werden (ne bis in idem), wird in der Europäischen Union auf mehreren Ebenen bei unterschiedlicher Reichweite gewährleistet. Mit dem Inkrafttreten der Grundrechtecharta hat die Vielschichtigkeit des Verbots zugenommen. Der Tagungsband greift zentrale Auslegungsfragen von ne bis in idem auf: Ist der Tatbegriff faktisch oder normativ zu bestimmen? Bedarf es eines autonom-europäischen Begriffs der Rechtskraft? Welche Voraussetzungen bestehen für die transnationale Wiederaufnahme von Strafverfahren? Lassen sich Einschränkungen des transnationalen ne bis in idem aufrechterhalten? Welche Rolle spielt die abweichende Handhabung durch den EuGH im Wettbewerbsrecht?
Die Autoren untersuchen die Judikatur des EuGH und EGMR und zeigen Divergenzen auf. Diese werden zum Anlass genommen, eigene Lösungskonzepte zu entwickeln.

englischThe prohibition of double punishment for the same act (ne bis in idem) is guaranteed with different scope on several levels in the European Union. With the entry into force of the Charter of Fundamental Rights the complexity of this prohibition increased. The conference proceedings include the most essential issues of interpretation of the ne bis in idem principle: Is the concept of „act“ to be defined factually or normatively? Is there a need for an autonomous European term of „legal force“? What requirements have to be fulfilled for a transnational resumption of criminal proceedings? Can the limitations of transnational ne bis in idem still be maintained? What role does the differing approach of the ECJ in competition law play?
The authors analyze judgments of the ECJ and the ECtHR and demonstrate differences. These give the authors the opportunity to develop their own solution concepts.
