Die im Zeitalter der Informationsgesellschaft stetig wachsende Bedeutung von Kapitalmarktinformationen erfordert eine grundlegende Systematisierung der einschlägigen Haftungsnormen. Dabei spielt das Verhältnis zwischen kodifizierter und durch richterliche Rechtsfortbildung entwickelter Prospekthaftung eine herausragende Rolle. Die im Rahmen dieser Analyse gewonnenen Erkenntnisse lassen sich auch bei der Haftung für in anderer Weise veröffentlichte Kapitalmarktinformationen fruchtbar machen, deren Existenz und materiell-rechtlichen Grundlagen bislang umstritten sind.
englischIn our information society, the importance of capital market information is steadily increasing and thus, requires a fundamental systematisation of the relevant liability provisions. In this context, the relationship between codified prospectus liability and prospectus liability developed further by judicial decisions plays a prominent role. The findings gained in the context of this analysis are also useful with regard to liability for capital market information published in other forms, whose existence and substantive foundations have been disputed.
